Terms and Conditions - V1.1 May 2022


The following are the terms and conditions you are agreeing to and an outline of the benefits offered by joining the Dragon’s Lair Monthly Membership. 

This agreement relates to your authority for Dragons Lair Holdings Pty Ltd or other debiting agent such as JoinIt being nominated to directly debit the nominated bank account or credit card for any instalments or fees due under the terms and conditions of this Agreement and Direct Debit Request. These terms and conditions are set out in this agreement.

1.1 Things to know at the start of your membership

Membership Benefits

  • Free entry to all regular weekly events for any game, including Magic: The Gathering, Digimon TCG, Yu-Gi-Oh, Flesh and Blood, plus more!
  • Entry to any special events are discounted by $5. This is any once-off event or event scheduled outside of the regular weekly event calendar.
  • Monthly members only offers! 
  • 5% discount storewide (exclusions apply, see below)
  • Additional 5% trade credit for TCG singles
  • Access to pre-made, competitive decks that update each month

How to redeem your membership benefits in store

The digital membership card provided must be loaded into a Wallet app or similar on a compatible device. This digital membership card must be sighted by a Dragons Lair employee to redeem any benefits in store. 

1.2 Membership FAQ and exclusions

Q: Can I use the membership for multiple games?
A: The membership can be used for any number of weekly events, across any games we support! 


Q: Does it include MTG Draft?

A: Yes, it does!


Exclusions for the 5% storewide are as follows:

  • No products already discounted or sale items (unless stated by Dragons Lair)
  • Food and drink products

2.1 Agreement Start & Renewal

Signing your agreement

You have an agreement with us when you have signed it and we have accepted it. If these terms and conditions or your agreement differ from anything you are told, these terms and your agreement will apply. 

First Payment 

Your first payment will be direct debited immediately when this agreement has been signed. 

Use of Membership

Your membership benefits will begin immediately once the initial direct debit has been confirmed. 

2.2 Monthly Renewal & Direct Debit

Paying by Direct Debit

Your membership fees will be debited from your nominated account at the agreed payment frequency, as set out in your membership agreement on the monthly anniversary of the agreement start date (or closest available date). You acknowledge that Dragons Lair Holdings Pty Ltd has been engaged to collect the fees due under this agreement if you are paying by direct debit and you acknowledge that our rights under this Agreement are able to be enforced without our involvement or your consent. 

Meeting your responsibilities

You must make sure:

  • your account can accept direct debits (your financial institution can confirm this)
  • there is enough money in your account on the payment day and the next 5 days
  • you tell us if you are transferring or closing your account, at least 48 hours before your next direct debit
  • you tell us about any changes to your credit card, such as its expiry date or number, at least 48 hours before your next direct debit.

Please notify Debitsuccess and your financial institution if you want to change or stop your direct debits.

2.3 Changes to the membership agreement

Updates to benefits or cost

Over time there may be updates or changes to membership benefits or very rarely cost. 

We will give you at least 28 days notice of any changes, by:

  • In writing via email and social media
  • By phone

This will allow for enough time to cancel your membership prior to renewal before the changes are in place. 

2.4 What happens if your payment is late or fails?

Missed Payment Notification

Upon renewal, if the direct debit is unsuccessful we will make up to 5 additional attempts as well as Dragons Lair and/or JoinIt will make a reasonable effort to let you know beforehand by:

  • Phone
  • Writing via email and/or social media messaging.
Losing your membership access

If you do not fully pay your fees on the due date, we will suspend your club access until your payments are up to date and you have given us your account details. Your membership renewal will need to be paid to regain access to the membership benefits. 

After 7 days of non-payment your membership will be removed and any members benefits or months accrued towards any milestone goals will be removed. 

2.5 Cancelling or Ending your membership

Cancellation

You can cancel your membership at any time before the renewal date. This can be done in writing to Dragon’s Lair or in your membership portal provided (supplied by JoinIt). This will cease any future direct debits.

Membership benefits will still remain active until the date of the membership’s current expiration. 

Refunds

Refunds are not available once the membership period has begun. Dragons Lair Holdings Pty Ltd reserves the right to offer a refund under extreme circumstances. 

2.6 Membership Termination

In extreme circumstances Dragons Lair reserves the right to immediately terminate this membership agreement. 

This includes actions such as:

  • Giving access of your membership card to another person
  • Repeated violation of the Code of Conduct
  • Etc

3.1 Our Membership Privacy Policy

 Your “personal information” (as that term is defined in the Privacy Act 1988 (Cth)) will only be used by Dragons Lair or JoinIt in accordance with the provision of their Privacy Statements.

During your membership we will only use, disclose or deal with your information in line with our privacy policy.

3.2 Statement of Commitment

Dragons Lair complies with the Privacy Act 1988 (Cth). This policy explains how we may collect, use, disclose and otherwise handle personal and sensitive information.

Dragons Lair is committed to safeguarding personal privacy. It recognises that individuals have a right to control how their personal information is collected and used. Providing personal information is an act of trust and it is taken seriously. Unless given consent to do otherwise, Dragons Lair will only collect and use personal information as set out below.

For the purposes of this Privacy Policy personal information may mean some or all of the following: A member’s name, contact details, date of birth, bank account and/or credit card details.

3.3 Collecting personal information

Dragons Lair will not collect or monitor any personal information about an individual without their consent. The only personal information collected is what is provided voluntarily by a member or prospective member.

We collect personal information primarily to enable us to provide members with our services or functions related thereto.

Dragons Lair may also use the information for marketing to you or for any other purpose permitted under the Privacy Act 1988 (Cth).

When a membership is purchased personal information will be requested in order to provide the requested service or product, provide updated information, and advise of other Dragons Lair products, which may be of interest. You are not obligated to provide personal information however failure to do so may result in Dragons Lair being unable to provide services or products to you.

Personal information is collected directly from members or potential future members when they personally complete and submit an application form to become a member

3.4 Using and disclosing your personal information

Personal Information will be used for the following primary purpose:

  • To fulfil obligations under a member’s membership agreement and/or any other contract between them and Dragons Lair;
  • To render services under a member’s membership agreement;
  • To provide information about products, service and/or special offers to members;
  • To obtain opinions or comments about products and/or services from members;
  • To record statistical data for marketing analysis from members;
  • To conduct market research and/or to improve Dragons Lair’s products and service offerings;
  • To administer contests, promotions and surveys;
  • For any other purposes that could be reasonably expected of Dragons Lair; and
  • To enable Dragons Lair to comply with its obligations under law. .

Dragons Lair may employ other companies or service providers to assist us in providing our services or any functions related to our services, including (but not limited to) marketing, market research, mail-house services, debt recovery functions, hosting and product development services, analysis of member lists and/ or consulting services. Dragons Lair may disclose, and these third parties may have access, to the personal information that is needed to perform their specific function. They cannot use that information for other purposes.

Allowing us to use your image. We sometimes film or photograph the club so it is possible you will appear in the background. By signing your agreement, you allow us to use your image in promotional and other business-related material. 

3.5 Contact by Dragons Lair

Dragons Lair does not send advertising information without obtaining prior consent. If an individual receives communications from Dragons Lair which they do not wish to receive, they may remove their name from the database by contacting dragonslairholdings@gmail.com

3.6 Individual’s right of access

A request may be made to delete personal and/or sensitive information, and all reasonable steps to delete the information will be made, except where it is required for legal reasons. 

3.7 Storage and security of personal and/or sensitive information

Dragons Lair takes all reasonable steps to keep secure personal information recorded and to keep this information accurate and up to date. We destroy or de-identify personal information we no longer need, wherever possible.



Dragons Lair reserves the right to review, amend, update and change this Privacy Policy from time to time to reflect its practices and obligations. Any changes will take effect when they are made or posted on our website.
